When someone is convicted of several crimes at the same time, courts normally impose one combined sentence. The question is how much each additional crime should affect that sentence.
Under a system sometimes called a multiple-crime or quantity discount, the court starts with the most serious crime and adds progressively smaller portions for the other crimes. As a result, the second crime affects the sentence less than the first, the third less again, and later crimes may have only a limited effect.
Supporters of changing this system argue that every crime and every victim should be properly recognised, and that committing many crimes should lead to a substantially longer sentence.
Supporters of retaining some reduction argue that simply adding every punishment together could produce disproportionate sentences. They believe courts should judge the crimes as a whole, including whether they formed part of the same event or series.
How should the votes be read?
Yes means that a crime should not automatically have less effect on the combined sentence merely because it is one of several crimes.
No means that courts should be allowed to let each additional crime contribute progressively less to the combined sentence.
This question does not mean that punishments must always be added together mechanically. For example, ten crimes individually assessed at five years would not necessarily result in 50 years in prison. Courts may still consider the overall seriousness of the crimes, connections between them, proportionality and the maximum sentence permitted by law.
Swedish Parliament decision
The parliamentary vote concerned the complete sentencing reform, not a separate proposal dealing only with multiple crimes. The package also included conditional imprisonment, removing the existing presumption against imprisonment, greater use of the full sentencing range and removing certain grounds for reducing sentences. The seed totals therefore represent the vote on the complete reform, although abolishing the multiple-crime discount was one of its most prominent elements.
